TERMS OF REFERENCE FOR A CONSULTANT TO REVISE THE PROCEDURE AND GUIDELINE FOR PROCUREMENT WITH COMMUNITY PARTICIPATION

BACKGROUND

     The Government of Mongolia, represented by the Ministry of Finance (“Client”), is implementing the “Third Sustainable Livelihoods Project” (SLP3), which is funded by the World Bank and the Swiss Agency for Development and Cooperation. The development objective of the project is “To improve governance and community participation for the planning and delivery of priority investment in rural areas of Mongolia.” 

     Within this broader development objective, the SLP3 aims to build capacity and improve information sharing to the citizens on the Local Development Fund (LDF) and to help enhance capabilities at the local aimag and soum levels in managing the LDF. One of the priority sets of capacity building activities, therefore, has targeted improving the budget execution and procurement processes in the rural areas. 

     Given the Project focuses on supporting participatory processes and building capacity in the governmental structure to successfully implement the Local Development Fund (LDF) not only through citizen engagements in the planning and monitoring processes, but also in the actual implementation and delivery of the priority investments. The Public Procurement Law of Mongolia (PPLM) has provisions that allow citizens’ participation in the actual implementation/delivery of sub projects and the MOF has put in place a relevant procedure and guideline for this. However, in light of the recent amendments to the PPLM (ratified in Parliament in 2019) and taking into consideration the practical challenges faced in implementing the existing procedure/guideline, the MOF seeks to review the relevant practical implementation on the ground and revise the procedure/guideline. 


OBJECTIVE OF THE ASSIGNMENT

     The objective of this assignment is to assist the Procurement Policy Division, Legal Department of the Ministry of Finance (MOF) in revising the procedure and guideline for procurements using the community participation procurement method that would help support and strengthen implementation of the LDF at the local level through engaging citizens in the actual implementation and delivery of the LDF sub projects. 

DETAILED TASKS AND / OR EXPECTED OUTPUTS: 

     Under the direct oversight of the relevant MOF and SLP3 PIU officials, the consultant will perform following tasks:

(i)    Review the current procurement procedures and guidelines that govern procurements with public participation;
(ii)    Visit selected soums that are preidentified to study the implementation on the ground of the existing procedure and guideline for procurements using community participation (LDF) and observe issues and needs for improvements in the relevant processes and practices; 
(iii)    Conduct a comparative research on procurement procedures and guidelines of other countries and international organizations that regulate procurements with community\ participation and analyze and identify international best practices applicable to Mongolia;
(iv)    Prepare recommendations to improve and update the existing procedure and guidelines for procurement with community participation based on the review, field visit findings and the comparative analysis conducted;
(v)    Prepare draft revisions to the current procedure and guideline for procurements with community participation;
(vi)    Provide technical assistance to the MOF in organizing consultative meetings with stakeholders to introduce draft revisions to the current procedure and guideline for procurements with community participation;
(vii)    Incorporate recommendations and inputs provided by stakeholders and finalize revisions to the current procedure and guideline for procurements with community participation; 
(viii)    Prepare the relevant training materials and conduct training of the newly adopted procedures and guidelines to the stakeholders including the NGO trainers to deliver the LDF Guideline training (Module 3 on Procurement) and selected soum users of the revised regulation; and
(ix)    Other tasks as reasonably assigned by the MOF.

EXPECTED DELIVEBRALES:

     The consultant will submit a monthly report to the MOF and the Project Implementation Unit of the SLP3 and the report shall contain progress and status of following deliverables:
-    recommendations for improving and updating the current procedure and guideline for procurements with community participation based on the review of the existing documents, field visit findings, and the comparative analysis of international practices that are potentially applicable to Mongolia;
-    draft revisions to the current procedure and guideline for procurements with community participation;
-    report on consultative meetings with stakeholders to introduce draft revisions to the current procedure and guideline for procurements with community participation;
-    final revisions to the current procedure and guideline for procurements with community participation.

CONSULTANT’S QUALIFICATION/SELECTION CRITERIA

     Successful applicant should have:
(i)    A postgraduate degree in procurement, law, business administration, public administration or a related field;
(ii)    5 years of relevant work experience in public procurement and legal work, of which preferably 2 years in developing legal documents and regulations and scientific research; and
(iii)    Intermediate level of skills in written and verbal English.
